The Oregon Supreme Court announced this Friday, March 5, 2010 that it has placed on its calendar a hearing of Case SO 58025: "Wendy Siporen, Ivend Holen and Medford Citizens for Responsible Development v. City of Medford and Wal-Mart Stores, Inc." to be held at North Medford High School on May 18, 2010 at 9 AM.

Oregon Supreme Court Accepts MCRD's Wal-Mart Appeal

Medford Citizens for Responsible Development (MCRD), through its attorney, Ken Helm, filed an appeal in December 2009 of the decision of the Oregon Court of Appeals which had reversed a Land Use Board of Appeals (LUBA) decision ordering the City of Medford to require a traffic study before granting necessary permits to WAL-MART Corporation to construct a retail superstore near the South Medford I-5 Interchange.

MCRD Chair Ivend Holen said he was hopeful that the Oregon Supreme Court's announcement that it will hear arguments in this case would help to dissuade WAL-MART from building a retail superstore at this location. The Oregon Legislature last week sent to the Governor legislation rescinding the generous tax advantages enacted earlier to induce corporations to construct passive-solar energy efficient buildings. Holen said WAL-MART had apparently been anxious to exploit the tax credits with the proposed superstore.

Holen said that the new South Interchange has greatly increased traffic, noise, and exhaust fumes in east Medford along Highland Ave and other neighborhood streets, and has resulted in the loss of on-street parking on Siskiyou Boulevard adjacent to Bear Creek Park. He said that in addition to the likelihood of massive traffic gridlock surrounding the proposed supercenter, the increased traffic has the potential to further devalue Bear Creek Park as a safe and pleasant place for community concerts and outdoor film screenings.

I wish you continued success on appeal to the state. One hurdle WalMart may have to face will be any "Negotiated Settlement Agreements" between ODOT and the county.

Good luck finding out in advance what that means. We've asked in many ways how they work?; where's the template?; the criteria?; what is it?, etc., but there is apparantly nothing beyond the overlay of standard land use laws and statewide goals.

Nice work, good luck. Keep everyone updated. Hearing up north? Carpools then?
